These terms are the agreement between you and Shalimar Luis LLC (“Binderverse”, “we”, “us”) for using binderverse.app. Binderverse is in early beta, which means things change often and occasionally break.
Draft — under review. Binderverse is in early beta. This document is a working draft pending review by counsel, and may change. We'll ask you to accept the reviewed version when it's ready.
1 · Your account
You need an account to use Binderverse. You must be at least 13 years old, and if you're under the age of majority where you live, you need a parent or guardian's permission. Keep your password to yourself — you're responsible for what happens under your account.
Give us accurate information when you sign up, and keep your email address current. It's how we reach you.
2 · What Binderverse is
Binderverse lets you organise, track and share trading card collections. Card images and card data come from a licensed third-party catalogue and belong to their respective owners. The card games, characters and logos referenced are trademarks of their owners and appear here for reference only. Binderverse is not affiliated with, endorsed by, or sponsored by any of them.
3 · Content you upload
You keep what's yours
You keep ownership of images and other content you upload. By uploading, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, resize, reformat and display that content solely to operate and provide the service — rendering it in your binders, in pages you choose to share, and in previews of those pages. This licence ends when you delete the content or your account, except where it has already been shared with someone who hasn't deleted it, or where we're required to retain it by law.
What you promise about it
By uploading content you represent that you own it or have the rights and permissions necessary to upload it and grant the licence above, and that it doesn't infringe anyone's copyright, trademark, right of publicity or other rights. You are solely responsible for what you upload.
Private by default
Artwork you upload is currently visible only to you. It does not appear on public share links, and there is no setting that makes it appear on one. Card images and binder structure you choose to share do appear publicly at the share link you generate.
Acceptable use
Our Acceptable Use Policy is part of these terms and sets out what you may not upload. Read it — it's short.
Screening, moderation and removal
Uploaded images are screened automatically before they are saved, using a third-party classification service. We may also review, remove or disable access to any content at any time, including content reported to us, without prior notice. We're not obliged to monitor content, but we reserve the right to.
Artist credit
Binderverse offers an optional artist-credit field on art placements. Adding a credit does not by itself establish that you have permission to use the work — the promises above still apply.
4 · Copyright complaints
We respond to notices of alleged copyright infringement as described in our Copyright & DMCA Policy. We terminate the accounts of users determined to be repeat infringers, in appropriate circumstances and at our discretion. We may also remove content, limit sharing, or suspend accounts for suspected infringement before or without a formal notice.
5 · Things you may not do
- Break the Acceptable Use Policy.
- Scrape, crawl, or bulk-download the catalogue, or use Binderverse to build a competing dataset.
- Interfere with the service — probing, overloading, circumventing rate limits or access controls, or working around the upload screening.
- Use someone else's account, or let someone else use yours.
- Resell or commercially redistribute access to Binderverse.
6 · Your information
We store your account details and the collection data you enter. When you upload an image, a copy of it is sent to a third-party content classification service (currently OpenAI) for automated screening; we send the image only.
We record when you accept these terms and the Acceptable Use Policy, including the date, the version you accepted, your IP address and your browser's user-agent string.
Our Privacy Policy sets out in full what we collect, which service providers see it, how long we keep it, and how to have it deleted.
7 · Beta
Binderverse is in early beta and provided “as is”, without warranties of any kind. Features change, break, and sometimes disappear. We don't promise the service will be available, uninterrupted, or error-free, and we don't promise that card prices or catalogue data are accurate.
Keep your own records. Don't rely on Binderverse as the only copy of anything that matters to you.
8 · Limitation of liability
To the fullest extent permitted by law, Binderverse is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or US$100.
Some jurisdictions don't allow these limitations, in which case they apply to the extent permitted.
9 · Ending things
You can delete your account at any time. We may suspend or terminate your account if you break these terms or the Acceptable Use Policy, if required by law, or if we stop operating the service. Where it's practical and lawful to do so, we'll tell you why.
10 · Changes to these terms
We may update these terms. When we do, the date at the top changes and we'll ask you to accept the new version. Continuing to use Binderverse after a change means you accept it.
11 · Governing law
These terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules, and any dispute will be brought in the state or federal courts located in New Jersey.
